WiperJet Return and Refund Policy

This policy outlines your rights regarding returns and refunds, in compliance with the laws of the Republic of Lithuania and European Union (EU) consumer protection directives. This policy is an integral part of our main Terms and Conditions.

1. Your Statutory Rights: An Overview

As a consumer in the European Union, you have two primary, legally-protected rights:

  1. The 14-Day Right of Withdrawal: The right to return a product for any reason within 14 days of receiving it (a "cooling-off" period).
  2. The 2-Year Legal Guarantee: The right to have a product repaired, replaced, or be refunded if it is faulty or not as described, for up to 2 years.

These two rights have different rules and conditions, which are explained below.

2. The 14-Day Right of Withdrawal (Returning Non-Faulty Goods)

This right applies only to Buyers who are "Consumers" (a natural person acting for purposes outside their trade, business, craft, or profession).

2.1. The 14-Day Period You have the right to withdraw from the sales contract within 14 (fourteen) days without giving any reason.

The withdrawal period begins:

  • From the day on which you (or a third party designated by you) acquire physical possession of the product.
  • If you ordered multiple products in a single order that are delivered separately: from the day you receive the last product.
  • If the product consists of multiple lots or pieces: from the day you receive the last lot or piece.

2.2. How to Exercise This Right To exercise your right of withdrawal, you must inform us of your decision with an unequivocal statement (e.g., an email) before the 14-day period expires.

2.3. Return of the Products You must send the products back to the address provided by an MB Latvilita representative without undue delay, and in any event no later than 14 (fourteen) days from the day you communicated your withdrawal.

You will have to bear the direct cost of returning the products.

2.4. Your Responsibilities & Condition of Returned Goods You are permitted to inspect the product to establish its nature, characteristics, and functioning (i.e., in the same way you would be allowed to in a physical shop).

You are liable for any diminished value of the products resulting from handling other than what is necessary for that inspection. To receive a full refund, the returned product must be:

  • Undamaged by you.
  • In its original, tidy packaging (this does not mean unopened, but the packaging should not be unnecessarily damaged).
  • In a clean, marketable condition.
  • Returned with all original parts and accessories (full set).

2.5. Our Refund Obligations We will reimburse all payments received from you, including the costs of delivery (except for supplementary costs if you chose a delivery type other than our least expensive standard delivery).

We will make the reimbursement without undue delay, and not later than 14 days from the day we are informed of your decision. We may withhold reimbursement until we have received the products back or you have supplied evidence of having sent them back, whichever is earliest.

2.6. Exceptions to the Right of Withdrawal The right of withdrawal does not apply to:

  • Goods made to your specifications or clearly personalized.
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

2.7. Inapplicability to Business Customers (Legal Entities) The 14-day right of withdrawal is a consumer right. It does not apply to Buyers who are legal entities (i.e., companies, non-profits, or other organizations) purchasing goods in the course of their business activities.

3. The 2-Year Legal Guarantee (Handling Faulty Goods)

3.1. Your Legal Guarantee (for Consumers) We are legally responsible for the conformity of the products we sell. All products sold in our store to Consumers are subject to a mandatory 2 (two) year legal guarantee of conformity.

This means we are liable for any lack of conformity (e.g., the product is faulty, not as described, or not fit for its intended purpose) that exists at the time of delivery and which becomes apparent within 2 (two) years from that time.

3.2. Your Rights if a Product is Faulty (for Consumers) If a product is found to be non-conforming, you (as a Consumer) have the right to request:

  1. Repair of the product; or
  2. Replacement of the product.

You may choose between repair or replacement, unless one of these options is impossible or would impose a disproportionate cost on us.

You are entitled to a proportionate price reduction or to terminate the contract (and receive a full refund) only if:

  • Repair or replacement is impossible or has failed;
  • We have not completed the repair or replacement within a reasonable time; or
  • The repair or replacement would cause you significant inconvenience.

3.3. Exclusions from the Legal Guarantee This guarantee does not cover defects or damage caused by:

  • Your own fault or negligence (e.g., improper installation, failure to follow use/maintenance instructions).
  • Use of the product for purposes for which it was not intended.
  • Repairs or modifications performed by an unauthorized service or person.
  • External factors (e.g., power surges, storms, liquid or fire damage).
  • Normal wear and tear.
  • Use of non-original accessories or parts.

3.4. Commercial Guarantee vs. Legal Guarantee A "commercial guarantee" (or "warranty") is an optional, extra promise offered by us or the manufacturer (e.g., "5-Year Manufacturer Warranty"). This is separate from, and does not replace or reduce, your mandatory 2-Year Legal Guarantee.

3.5. How to File a Guarantee Claim (for Consumers) To make a claim under the legal guarantee, you must contact us at wiperjetshop@gmail.com with:

  1. A description of the defect.
  2. Proof of purchase (e.g., order number or invoice).

We will guide you through the process of returning the product for inspection and (if the claim is valid) repair, replacement, or refund.

3.6. Warranty for Business Customers (Legal Entities) For Buyers who are legal entities (businesses), the 2-year mandatory legal guarantee for consumers does not apply. Purchases made by legal entities are subject to the commercial guarantee terms (if any) provided by the product manufacturer. Please refer to the product documentation for details on any applicable manufacturer's warranty.

4. Dispute Resolution

We will always try to resolve any issue with you directly. If you are not satisfied with our proposed solution, you (as a Consumer) have the right to seek an out-of-court resolution:

  1. State Consumer Rights Protection Authority (VVTAT): You may submit a request or complaint to the VVTAT of the Republic of Lithuania (Address: Vilniaus g. 25, 01402 Vilnius, email: tarnyba@vvtat.lt, website: www.vvtat.lt).
